Dealing with split families

Split families, we all know there are so many different complexities surrounding these matters!

Numerous times a week we find ourselves repeating the same conversation with debtors that say they are “unaware” that there was a debt outstanding, or that the quantum of the debt was so high.

Here are a few tips to ensure that the debt doesn’t come as a “surprise” to either parent:

• Ensure that you have up to date contact details for both parents and that you are sending statements to both, whether it be via email or post
• Seek repayments from both parents
• Do not get drawn into communicating with only one parent. In the event that one parent states they are communicating on behalf of the both of them, ensure that both parents are included in on any correspondence
• In the event of default in payment, make both parents aware because any action taken may affect both
• Do not disclose personal information regarding one parent to the other, just simply advise that there are negotiations in progress/or repayments being made. The statement they receive will reflect any payments received from the other parent

It all comes back to having proper enrolment paperwork which imposes joint and several liability, signed by all parties that are to be liable. Then being consistent and transparent in your dealings with each.
